Call to Order
The regular public business meeting of the Schuylkill Township Board of Supervisors was called to order at 7:30 p.m. with Supervisor Parry leading the Pledge of Allegiance. The meeting was chaired by Supervisor Parry.
Supervisor Parry advised the audience that meeting attendees not on the agenda who wished to address the Board of Supervisors will wait to be recognized by the Chair, then proceed to the microphone and identify themselves for the record. Supervisor Parry said that statements to the Board will be limited to 3 minutes and comments by unrecognized persons will not be acknowledged. Supervisor Parry reminded meeting attendees that any proposed agenda items must be submitted to the township manager for consideration no later than 12:00 noon on the Wednesday preceding any given Board meeting and that late submissions will be not be placed on the current agenda but held for a subsequent meeting unless approved by the Chairman of the Board.
Upon motion by Supervisor Cohen, seconded by Supervisor Majewski, and unanimously passed, the Board of Supervisors of Schuylkill Township accepted and approved the October 5, 2016 Board of Supervisors Regular Meeting Minutes, and all departmental, committee, commission and council reports as posted and received by the Board of Supervisors for the month of October 2016.
Board Member Reports
Phoenixville Regional Planning Committee (“PRPC”): Supervisor Cohen advised the Board that a presentation was made to the PRPC on by Susan Elks, AICP, of the Chester County Planning Commission on the Landscapes 3 program currently in development. Supervisor Cohen advised the Board that the PRPC has received the Chester County Vision Partnership Program grant for updating the Regional Plan. Supervisor Cohen also noted that the Knox Covered Bridge is scheduled to open by Thanksgiving.
Environmental Advisory Council (“EAC”): Supervisor Majewski reported on the October 29th Valley Park Road cleanup sponsored by the EAC, stating that over 400 pounds of litter and debris was picked up, and thanked the Valley Forge Volunteer Fire Company’s Fire Police and the Schuylkill Township Police Department for their assistance. Supervisor Majewski informed the Board that the EAC Schuylkill Township multi-modal map was presented to the Planning Commission at their last meeting. Some changes were suggested by the Planning Commission, the EAC is currently working on those and will present the map to Board when the changes have been incorporated.
Treasurer’s Report and Payment of Bills
Supervisor Majewski, Treasurer, advised the Board that as of October 31, 2016, the Township’s general fund shows a balance of about $3.7 million. Supervisor Majewski reported that the bills for October 2016 have been reviewed and she recommended payment of these bills.
Upon motion by Supervisor Cohen, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and accepted the Treasurer’s Report for the period ending October 31, 2016 and authorized payment of Township bills for the period ending October 31, 2016.

Tuesday, November 8, 2016 – General Election. Supervisor Parry strongly encouraged township residents to exercise their right to vote.
Supervisor Cohen informed residents on November 9th, the Schuylkill River Heritage Center will be hosting a presentation by Mary Ann Eaves, Society of Industrial Historians and Archeology on the 1876 Centennial Celebration held in Fairmount Park.

Stove Shop Site Work and Licensing Agreement
Upon the request of the township engineer, this item was removed to executive session.
Gilmore & Associates, Inc. Contract for Intersection Improvements Pothouse Rd/Charlestown Rd/Bridge St.
Upon motion by Supervisor Parry, seconded by Supervisor Cohen, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and accepted the Gilmore & Associates, Inc. contract agreement for the Charlestown Road/W. Bridge Street (SR 1019) & Pothouse Road (SR 1036) Intersection Improvements in Schuylkill Township, Chester County, PA conditioned upon a final review by the township solicitor.

Mr. Pete Mercuri, President Pickering Glen Homeowners Association, expressed his dissatisfaction with the lighting installed at the intersection of Pothouse Road and Trotters Drive and the replacement curbing installed by PennDOT at that same intersection. Supervisor Parry recommended that these issues be put before the Phoenixville Area School District. Mr. Mercuri also reiterated his complaint about no light at the end of Mr. Colket’s driveway.
Mr. David Faggioli, Delaware Valley Properties II, LLC, addressed the Board regarding his property at 330 Pawling Road and the Boards requirement for a site plan. Mr. Faggioli recapped the agreement reached between Schuylkill Township and him wherein each party would pay half of the cost of a site plan to be prepared by the township engineer. Mr. Faggioli informed the Board that he has decided not to enter into this agreement because it was his opinion it would lead to additional costs in plan reviews, etc. The township solicitor, Mr. Brennan, asked Mr. Faggioli if he had read his (Mr. Brennan’s) email in which he outlined the agreement and specifically stated there would be no formal plan review process. Mr. Faggioli said he did not. Mr. Brennan read the aforementioned email of October 17, 2016, the subject being “RE: Schuylkill Township Land Development” and which is incorporated herein by reference. Mr. Faggioli stated his perception that the email says there will be no land development review but does not exclude other reviews. The township engineer, Mr. Sartor, clarified to the Board that if Gilmore & Associates, Inc. prepares a survey plan of Mr. Faggioli’s property, there would be no review by the township engineer because Gilmore prepared the plan. Supervisor Parry asked Mr. Faggioli why he was addressing the Board. Mr. Faggioli said he brought a plan from Wilkinson Engineers which shows the elevations on the site. Mr. Sartor asked if this plan was signed and sealed by a professional engineer. Mr. Faggioli replied no. Mr. Sartor asked if the plan was 24” x 36”. Mr. Faggioli said he just received the plan today and he has not had time to do that. Mr. Sartor informed Mr. Faggioli that a site plan submitted to the township must be plotted on 24” x 36” paper, and signed and sealed by a profession engineer. Mr. Faggioli asked if the engineer had to do a survey; Mr. Sartor responded that he must have already done a survey because Mr. Faggioli had the elevation plan in hand. Mr. Faggioli responded that the engineer had not done the survey; the plan was extrapolated from a previous survey in his (Mr. Faggioli’s) possession. Mr. Brennan recapped the circumstances of the issue which led to this point and stated his recommendation that the Board consider tonight the next course of action to be taken in the matter. Mr. Faggioli stated his opinion of the issue in that he was not doing land development, he was only doing interior renovations on a building, and should not have had to comply with land development requirements. Mr. Sartor replied that at a meeting held with Mr. Faggioli and the township zoning administration officer about a year ago, he informed Mr. Faggioli that there was unapproved site work taking place of which no one in the township was aware, and suggested he should go before the Board of Supervisors to explain that this activity was not in violation of the land development waiver granted by the Supervisors. Mr. Faggioli said he did come before the Board to explain the site work; that he was only replacing asphalt with asphalt, not raising the building or changing the grades at which point he said he was told a plan would have to be provided to document existing elevations which, in his mind, escalated to a land development, drainage, survey. Mr. Sartor corrected him stating that no land development plan had been requested. Supervisor Cohen commented that while she appreciates the improvements being made, it does not negate that fact that the township needs a complete record of the site and the township is willing to share the cost of providing that record. Supervisor Parry concurred with Supervisor Cohen and told Mr. Faggioli he could see no reason why Mr. Faggioli could not comply with the request being made by the township. Mr. Brennan said that Mr. Faggioli had agreed to this but now has decided to revoke that agreement and his recommendation would be to take further action. Mr. Faggioli stated his opinion that providing the plan will lead to something else; all he is doing is renovating the interior of a building and trying to improve the property. Mr. Sartor replied that Mr. Faggioli has yet to provide the information he agreed to provide and he has neglected to mention to the Board that he actually did fill on part of the property and did change the grade on the property by more than two feet. Supervisor Cohen closed the discussion saying that the township is looking for a decision from Mr. Faggioli on whether he would accept the agreement to have the township engineer draw up the required site plan with the cost split between the township and Mr. Faggioli.
An executive session was called to order at 8:15 p.m. Present were Supervisor Cohen, Supervisor Guerette, Supervisor Majewski and Supervisor Parry. Also present were the Township Solicitor, Mr. Brennan, and Township Secretary, Mrs. Harbison. The executive session closed at 9:00 p.m. Supervisor Parry reported that litigation and personnel matters had been discussed.
2017 Draft Budget Review
Supervisor Parry commented that the draft budget presented tonight is balanced with no township tax increase for the 9th year in a row and extended the Board’s appreciation to the township manager and treasurer for their hard work. Supervisor Majewski, Treasurer, presented the Board with a balanced budget. The proposed budget does not require a real estate tax increase. A Tax Anticipation Note is not anticipated for the beginning of 2017. The Board reviewed both receipts and disbursements for 2017.
Supervisor Guerette requested that in light of the financial contributions being made by the township to the Valley Forge Volunteer Fire Company (“VFVFCo) that the VFVFCo provide regular financial reports to the township commencing with the January 2017 meeting.
Upon motion by Supervisor Majewski, seconded by Supervisor Cohen, and unanimously passed, the Board of Supervisors approved and authorized the Assistant Township Manager to advertise the proposed 2017 budget for consideration of approval at the December 7, 2016 Board of Supervisors meeting.
There being no further business before the Board, the meeting was adjourned at 9:50 p.m. upon motion of Supervisor Majewski, seconded by Supervisor Cohen, and unanimously passed by the Board of Supervisors.
